Mediation and Settlement
Be it a business dispute or a complex family conflict, mediation is quick to set up, saving time and money. The aim of a business mediation is to find settlement within an eight-hour session, a few days at most. Family mediations tend to be spread over several weeks.
Cost effective – Costs are kept to the minimum and are split equally between the parties in dispute.
Improves communication & understanding – Conflicting parties invariably become entrenched, going round in circles. The mediation process breaks the deadlock facilitating renewed communication and in so doing helps the parties focus on and clarify the real issues.
Flexible – A mediation session is not a quasi-court. There is no-one sitting in judgement. The process is voluntary, non-binding and without prejudice. It is not adversarial and there is no point scoring. The mediation session is informal allowing the parties to have full participation in the decisions. This informal atmosphere encourages more creative solutions which the courts do not necessarily have.
Addresses reality – The process of mediation brings the real issues to the fore. The mediators skill is in focusing on each party's expectations and claims, reality testing and moderating them where necessary.
Confidential – The mediation process and its run-up is totally confidential. (NB: financial disclosure in Divorce settlement is not confidential.)
