There were no witnesses to my accident - can I still make a claim?
Having an independent witness to any accident can help your claim but it is by no means essential. The courts will usually believe the victims of accidents unless there is anything that leads them to suspect that the slip and trip compensation claim is not genuine.
The edge that I tripped over was not very deep - does that matter?
The general starting point for tripping accidents outdoors is that the difference in height between the two pavement surfaces has to be at least 1 inch; if it is less than 1 inch then there is a chance that there will be no claim for compensation. A good way to test the height difference is to place a 50 pence piece next to the pavement edge, if the difference in height between the two surfaces is greater than the height of the 50 pence piece you probably have the grounds to make a claim.
If I have had previous accidents do I have to tell you about them?
It is essential that you tell us if you have been involved in a similar accident before. Often it will not make any difference to your claim, but concealing previous accidents can damage your credibility as a witness and may make the court less inclined to believe your statement.
